Home Office - Certificate of Approval
Certificate of Approval from the Home Office for Civil Marriage or Civil Partnership is required if:

  • one or both parties to the marriage or civil partnership is not a British or EU citizen
  • one or both parties to the marriage or civil partnership have restrictions on there stay (i.e. limited leave to remain or enter in the UK)

One of the main criteria for obtaining a certificate of approval is that the applicant has been granted leave to remain or enter in the UK for over 6 months and at least 3 months are remaining of that leave at the time of application.

Changes to the scheme following the High Court judgment of 10 April 2006

Following a judgment in the High Court amendments were introduced for applicants who had insufficient leave to enter or remain in the UK to meet the published COA criteria when applying.

Under these new procedures if you were a person who had insufficient leave to enter or remain at the time of applying for a COA, the Home Office may write to you asking that you submit further information in support of your application to enable us to be satisfied that your proposed marriage or civil partnership is genuine.
